1. Acceptance of the Terms
These Terms and Conditions of Use (the “Terms”) govern access to and use of the website, mobile
application and any other digital platform operated by Bubble FresH Laundry Md (the “Platform”), as
well as the ordering of laundry services with pick-up and delivery provided by Bubble FresH Laundry
Md (the “Services”). By accessing, browsing or using the Platform, the user (“User”) represents that he
or she has read, understood and agrees to be legally bound by these Terms. If the User does not agree
with any provision of these Terms, the User must refrain from using the Platform and from ordering the
Services.
2. Identity of the Company
Bubble FresH Laundry Md is a company engaged in the provision of laundry services, including,
without limitation, washing, drying, folding of garments and pick-up and delivery services, as well as
subscription plans based on bags or containers of a defined capacity, within a service area described
on the Platform and updated from time to time.
3. Permitted Use and Licence
The Platform is made available to the User solely for the purpose of allowing the User to obtain
information about the Services, manage an account and place orders for laundry Services offered by
Bubble FresH Laundry Md. The User is granted a limited, revocable, non-exclusive, non-transferable
and non-sublicensable licence to use the Platform in accordance with these Terms. The User is
expressly prohibited from using the Platform for unlawful purposes or in breach of these Terms, reverse
engineering or decompiling the software, interfering with its normal operation or exploiting the Platform
commercially without the prior written consent of Bubble FresH Laundry Md.
4. Account Registration
To access certain features, the User may register and create an account (the “Account”). The User
agrees to provide true, complete and up-to-date information, to maintain the confidentiality of his or her
login credentials and not to allow third parties to use the Account. The User is solely responsible for all
activity carried out through the Account, whether or not authorised. Bubble FresH Laundry Md may
suspend or cancel Accounts at any time and at its discretion, especially in case of misuse or breach of
these Terms.
5. Privacy and Personal Data
The processing of the User’s personal data will be governed by the Bubble FresH Laundry Md Privacy
Policy, which forms an integral part of these Terms. By using the Platform, the User authorises Bubble
FresH Laundry Md to process his or her data in accordance with such policy, including the use of
contact details to send communications relating to orders, subscriptions, service notifications and,
where permitted by law, marketing communications about Bubble FresH Laundry Md products and
services.
6. Specific Conditions Governing the Laundry Services
By ordering the Services, the User accepts that pick-up and delivery of garments will be carried out at
the addresses and within the time windows indicated by the User and accepted through the Platform.
Bubble FresH Laundry Md will use reasonable efforts to comply with the assigned time windows;
however, the User acknowledges that delays may occur due to traffic, weather or other circumstances
beyond the company’s control.
For subscription plans based on bags, each bag will have a maximum capacity, either by weight or by
volume, as indicated on the Platform. The User undertakes not to overload the bag beyond the stated
limits; otherwise, Bubble FresH Laundry Md may charge additional fees, split the laundry into more than
one service or refuse to process the excess.
The User represents that all pockets have been emptied and that items not related to clothing have
been removed, and that delicate or special-care garments have been separated when appropriate and
any specific instructions have been communicated through the channels made available on the
Platform. Bubble FresH Laundry Md shall not be liable for damage caused by objects left in pockets or
for pre-existing defects in the garments.
In the event of damage to or loss of garments reasonably attributable to Bubble FresH Laundry Md, the
company’s liability will be limited, at Bubble FresH Laundry Md’s option, to repairing the garment where
feasible or paying financial compensation based on the reasonable replacement value, subject to the
maximum per-order limit indicated on the Platform. Bubble FresH Laundry Md will not be liable for
indirect damages or for any sentimental value associated with the garments.
If, for reasons attributable to the User, delivery of the garments cannot be completed within a
reasonable period of time, Bubble FresH Laundry Md may charge storage fees and, after the period
communicated on the Platform or in internal policies has elapsed, may treat the garments as
abandoned and dispose of them in accordance with applicable law.
7. Payments and Billing
Service prices and payment methods will be displayed on the Platform. The User authorises Bubble
FresH Laundry Md and/or its payment service provider to charge to the User’s card or other accepted
payment method the amounts corresponding to the ordered Services. Unless expressly stated
otherwise, charges are non-refundable once the garments have been picked up or the Service has
commenced. For subscriptions, charges may be made on a recurring and automatic basis until the
User cancels the subscription in accordance with the instructions provided on the Platform.
8. Liability, Disclaimer of Warranties and Indemnification
The Platform and the Services are provided “as is” and “as available”, without any warranties of any
kind, whether express or implied, including, without limitation, implied warranties of merchantability,
fitness for a particular purpose and non-infringement. Bubble FresH Laundry Md does not warrant that
the Platform will operate without interruption or error or that it will be free from viruses or other harmful
components.
To the fullest extent permitted by law, Bubble FresH Laundry Md shall not be liable to the User for any
indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business
opportunities. Where the law does not allow a full exclusion of liability, the total aggregate liability of
Bubble FresH Laundry Md to the User shall be limited to the amount actually paid by the User for the
Services in the three (3) months preceding the event giving rise to the claim.
The User agrees to indemnify and hold harmless Bubble FresH Laundry Md, its directors, employees
and agents from and against any claim, damage, penalty, cost or expense (including reasonable
attorneys’ fees) arising from the User’s use of the Platform or the Services, from any breach of these
Terms or from any violation of third-party rights.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland,
United States of America, without regard to its conflict of laws rules. Any dispute arising out of or
relating to the Platform, the Services or these Terms shall be submitted to the state or federal courts
located in Montgomery County, Maryland, except where mandatory law provides otherwise.
10. Final Provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain
in full force and effect. These Terms, together with the Privacy Policy and any specific service
conditions published on the Platform, constitute the entire agreement between the User and Bubble
FresH Laundry Md with respect to the Platform and the Services. The failure of Bubble FresH Laundry
Md to exercise or enforce any right shall not constitute a waiver of such right. Any claim relating to the
Platform or the Services must be brought within one (1) year from the date on which the cause of action
arose; otherwise, such claim shall be permanently time-barred.
